The Appraisal Process – Know your rights!

How Does it work?

The Appraisal Clause grants you the right to engage an independent Appraiser to determine the value of the loss. Both parties (you and the insurance company) engage their own autonomous Appraisers, and the two Appraisers will choose a non-biased Umpire. In the event of a disagreement, the two Appraisers present their findings & differences to the Umpire who will make a ruling. These three individuals are known as the Appraisal Panel.

The goal of the Appraisal Panel is to determine the value of a loss and to agree to a fair settlement amount. When the Appraisal Panel has been appointed, both Appraisers will examine the affected property, associated documents, estimates, and discrepancies.

These two Experts will attempt to negotiate and settle the fluctuations of the loss value between themselves. If they come to an agreement, means a fair settlement amount has been established, the claim is settled. However, if they can’t consent they will present their findings to the Umpire for a decision.

The Umpire’s decision becomes only valid by a majority agreement, which means that any one of the two Appraisers has to agree to the Umpires decision. Once the award agreement has been signed by the Umpire and any one of the two Appraisers, the amount on the award is binding and is paid by the insurance company to you.

You should also know that there is no set regulation as of how fast you have to invoke your Appraisal Clause after a loss.
